A husband mentioned to me that he wants to surprise his wife with a home. Is it required that she be on the contract although the wife will sign on the deed and other paperwork at the Title company?

If she is not on the mortgage she just signs the deed at closing

My buyer would like to match my commission that is offered by the listing broker so is there a form for me to use to obtain consent from all parties?

Hey Eric, Great Question. you will need the Buyer's Representation Agreement, the Compensation Agreement Between Brokers (Or compensation agreement between broker and owner), and lastly the addendum regarding broker fees. All of these documents deal with commission! If you already have an agreement set in place with a set commission and would like to change that just add an amendment and get it signed by all parties. In short, earnest money can only be lost if the buyer fails to timely perform contractual obligations not the seller.

If a seller wants to sell the house for more than the average compared value analysis is, would a 16month exclusive right to sell agreement be legitimate?

The time limit is actually what is agreed upon between the Broker and Seller. As long as the listing agreement has a begin and end date on the listing agreement.
