If a seller wants to sell the house for more than the average compared value analysis is, would a 16month exclusive right to sell agreement be legitimate?

Jose, you can set the agreement effective period for any time you and the seller agrees, however, remember that the seller can still terminate at any time. Why take the listing if you're not in agreement on the price (particularly if it's much higher than market value). You should explain to the seller all the reasons why it's such a horrible idea to overprice the home rather than lock them (and yourself) into a long 16-month listing agreement. You'll waste marketing dollars marketing an overpriced home and it only hurt the seller and your pocket.

No. But becomes enforced when you have it in writing. Why specifically a 16 month time frame? Is it because the houses don't sell in that location? Based on the comps, are houses in that market average 16 month to sell?

All Texas contracts have an expiration date. For a Listing Agreement the expiration date typically corresponds to how long the Broker and seller determine it will take to sell the property. Everything is negotiable.

You can write in automatic price decreases every 2 weeks etc. Speak with your broker for specific language and determine if taking listing makes sense.

No. Its depend on Sellers.Its Sellers market and if Price is right, you have no Problem to sell it. i always Provide CMA to my sellers and agreed on Price., at least I put on agreement 6 months.

Yes, on the listing agreement there is an end date for the listing. I usually do a listing agreement for 6 months.

16 months for a listing agreement is legitimate because it’s negotiable as long as the seller and broker are in agreement with that timeframe. Usually I do a listing agreement for 6 - 12 months for residential depending on location. I would also advise to price the home just a bit above fair market value.

The time limit is actually what is agreed upon between the Broker and Seller. As long as the listing agreement has a begin and end date on the listing agreement.

16 months seems a bit long but it all depends on the seller and the property. Rural areas tend to take longer to sell so 12 months is not unheard of. It comes down to what the seller wants to do. There’s not a limit on length of time except what you execute on the agreement. It’s better to price it at fair market value and sell fast. In this crazy seller’s market, when a property sits too long, it can become stigmatized.

Sounds like you think you will need awhile to get them this price. I would advise sellers this high market is already starting to change. I would try instead to get them to price it just a little over the market and get it sold. If the market slows down as predicted they will be very thankful you were honest with them. You don’t want to list a home that is going to take a year and a half to sell. Price it to get it sold In Under 6 months. Start date and end date are in 1-4 and it is negotiable. Average however is six months. Good luck!

Yes. The time limit is stated in the listing agreement. The seller signed a contract which specified a start and end date. The duration of the contract is negotiable between the seller and listing broker.

There is always an end date to a legal contract, so when a listing agreement is written, it includes a date of expiration too. The date is negotiable between the listing broker and the seller, and this date can be amended easily at any time by both parties signing an amendment. A listing may also be terminated at any time by either party, regardless of the expiration date, by signing a termination of listing document.

Yes! It has to have an end date. A typical listing agreement for Residential is 6 months and at least 12 mnths for a Commercial. But everything is negotiable! Sometimes it could be extended after expiration. It is always negotiable between the Seller and Agent, as long as both parties agree!

I have sold multiple homes for more than market analysis. Alot of variables went into that though, like set up, photos, music videos and alot of advertising. Yes, you can do a 16 month agreement, if your seller is in agreement. Having said that, an "average sold price" is not necessarily always the way to price the property right. A lot of other aspects affect the list price.

Yes, all contracts have an end. And the listing agreement is a contract between the seller and the listing broker. That time limit is negotiable between the two parties of that contract.

There is No Limit on how long it can be. The Listing agreement has to have the end date, however it can be as long, or short, as the broker and the seller agree to.
You just want to have enough time to sell it.

In your listing agreement with your agent there is a dated end date for the listing. I typically do a listing agreement for 6 months. Sometimes the agreement is less, sometimes more. But the answer to your question is yes.

The duration of a listing agreement is negotiable. Agents invest in listings, time, photos, marketing materials, etc. and often have a minimum time that they want for a listing.
