I have a buyer who has no representation and is not a Realtor, to change to pending I see I can put non MLS Realtor, but they are not a Realtor. How do I get it changed to pending?

I agree that it is better to refer the buyer to a real estate agent. There are obviously many benefits for them and they don't have to pay the sellers commission.

If there is no representation and there is not a cooperating broker, I would ask to buyer if they want representation in which your broker can assign another agent or you can represent both sides. If they do not want representation, then you can make sure the documents are prepared and submitted maintaining your sole responsibilities to the seller and working as a sub-agent for the buyer. Make sure they initial the IABS and understand your duties either way they want to proceed and if you or another agent from your office represents them, get the intermediary addendum signed by buyer and seller. If not represented, put yourself as the selling agent and under the question, " Did selling agent represent buyer?" select no. If they are a licensed real estate agent but not a member of HAR, down at the bottom you can input License number.

I agree with Deborah. I would assign the buyer to another realtor, as that way you would not be compromising with your fiduciary duties towards your seller. Its much cleaner that way.

Intermediary docs are key to these types of transaction. Contract class heavily insists on how these needs to be handled properly so it doesn't come and bite later. Your broker should be able to guide you.

There are three alternatives for the brokerage firm and the parties to consider:

1. The firm, acting through the salesperson or associated broker, could represent one of the parties and work with the other party as a customer rather than as a client (realistically, this probably means working with the buyer as a customer and terminating the buyer representation agreement).

2. If the firm has obtained permission in writing from both parties to be an intermediary and to appoint licensees to work with the parties, the salesperson or associated broker could be appointed by the intermediary to work with one of the parties. Note: Another licensee would have to be appointed to work with the other party under this alternative. The law does not permit an intermediary to appoint the same licensee to work with both parties.

3. If the firm has obtained permission in writing from both parties to be an intermediary, but does not appoint different associates to work with the parties, the salesperson or broker associate could function as a representative of the firm. Since the firm is an intermediary, the salesperson and associated broker also would be subject to the requirement not to act so as to favor one party over the other.

You will have to be the representing Realtor. Does your broker allow this? The buyer and seller will have to sign the Intermediary document. If your broker doesn’t allow then you wil need to contact a Realtor to represent the buyer. You can ask the Realtor to pay you a flat fee, percentage or give them the customer without asking for compensation.
