I'm a realtor and plan to establish a LLC for myself to cover all the real-estate related business. Is this allowed by TREC? On the future listings/representation agreements, do I list myself or my LLC's name?
Thanks.
Yes you can have an LLC, but as previously stated check with your broker to make sure they are ok with it. When I was with Keller Williams, it was highly recommended and encouraged. You introduce yourself as the owner of Blank Realty or what ever you name your LLC, and you are Partnered with Blank Brokerage. All listing agreements and contracts will need your brokers information as TREC requires. Your business cards, Signs and web site can use your LLCs name with appropriate display of Brokers...

You are a private contractor, you are not employed by your broker, but TREC does mandate you show brokers information as you must be sponsored by one until you get brokers license.
I agree with Zelda. When you work under a brokerage al listings belong to the brokerage. So as a result any real estate transactions belong to the brokerage. Example Remax Executive or KW Woodlands they are still under the brokerage but of a separate location. There is still a sponsoring broker and all agents work under that broker's license. Now if you have team xyz as some companies have they are teams but still under the brokerage. If you are starting out as a new broker on your own the...

If you are starting out as a new broker on your own then yes you can have the option to do a LLC, or whatever entity status that your CPA feels is best for you. Realtors are independent contractors for tax purposes but they are not separate from their brokerage. Hope this helps
As a Realtor, yes you can establish an LLC however I recommend you meet with your CPA to be sure your tax liabilities are understood.
In addition you need to consult with your Broker to see if they are ok with you having an LLC for your real estate business. If you are not the Broker then all of your contracts are done in the name of the Broker anyway and all of your checks regarding real estate sales will have to come from the Broker as well.
