Buying a house, we finally finalized the contract, then we get the sellers disclosure that says there had been termites but the house was treated for them. We got the inspector out and he found live termites, is the seller responsible for paying for the new treatment? \n\nWe requested he pay for the treatment and he is refusing, can we do anything?\n\nThank you!

I would check to see if you are still in your option period. You should have received the Sellers Disclosure at the beginning of the transaction. I suggest you get an estimate to see what it would cost to treat the termites. You then have three options: terminate, renegotiate or leave things as they are. Let your realtor be your guide and let your gut help you decide.

This just happened to us. Seller accepted offer but will allow no option period. In Dallas, TX.

The short answer is yes. It is a negotiated item in the contract that the seller does not have to agree to. You as the buyer must decide if you want to continue without it or not enter into the contract to begin with. Without the option period, if you terminate the contract, even for just cause, you will lose your Earnest Money Deposit.
