Good morning - I am new to the community and have a question regarding Certificate of Occupancy from a Tenants perspective. \nThe question is this: Is a Tennancy Agreement void or voidable if it is discovered that the Landlord failed to obtain a Certificate of Occupancy for the leased property within the City of Bellaire?\n\nI have heard that this is a mandatory Certificate which must be in place.\n\nThank you

Yes. A certificate of occupancy is required in the city of Bellaire, for residential rental properties. It is unlawful to reside in a rental property that does not have a certificate of occupancy.
