Title could not accept my buyers earnest money due to another contract from August 2021 where the buyer signed but never funded and has disappeared. Demand letter just sent out. Nothing was done for couple months. Property was relisted in August and seller has now signed and executed new contract with my buyers & we are unable to perform.

This is a bit of a mess. Unfortunately the previous agents and title company have some loose ends hanging, which you will need to find out where this stands from seller, previous agents and title company. \n\nFirst, get your broker involved if you are not familiar with a situation like this. The Title company facilitates parties and should be able to give you the information as to why this contract is hanging. You said the buyer \"disappeared\", there must have been non performance but you need to ask why earnest money hasn\'t been dispersed?\n \nIf this has not taken place, the listing agent cannot re-list the home because the contract is not dissolved. \nThis is a situation where your broker can guide you but you will need to learn why this contract is still not dissolved. \nAlso, the current listing agent would have these answers.
