When the Seller is selling the house, they are not obligated to change or fix anything. Homes in Texas are generally sold as is. So if the buyer would like to purchase the house they need to accept the state it is in.

Unless the seller agreed to repair the house in writing, on the contract, the seller does not have an obligation to repair anything. The buyer can walk away if they are still in the option period and their earnest money should be returned. That's the reason for the option period. I hope that helps.

If you're representing the seller, hopefully you've priced it accordingly. Texas contracts are As-is contracts. So, if the property has already been priced to reflect the condition, seller does not need to accept any repair requests and the buyer can move on if they don't accept that fact or if their lender is requesting repairs. If still within option period, release earnest money and move on. If within the third party finance period, same, release earnest money and move on. If outside of either, speak with your broker and see what your office policy is.

If you're representing a buyer, most of the above applies.

Good morning Jerri, you need to provide more information. Are you representing the buyers or the sellers? Is the property under contract and still within the option period? Were any repairs agreed to in writing?
