At this point, how you proceed depends heavily upon how the buyer prefers to move forward. The seller has contractual obligations, which mostly include selling and conveying clear title. If this is a SFR contract, I suggest (1) Understanding why he\'s chosen not to sell (2) Confirming whether the decision has anything to do with title (3.) I would refer the seller to the contracts\' Page 8 Section 15., so that he understands the risks & remedies related to defaulting. Both clients should reconcile whether the costs to mediate or litigate are more advantages than terminating and releasing EM. Someone else mentioned that the seller will also still owe you the Listing Agreement Contracts\'s commission, since per the terms of that agreement, you\'ve procured an acceptable buyer who is at this point, willing and able to close. Generally there is no fee paid to the agent by the tenant in lease transactions. Similar to the buying and selling process the property owners broker or the apartment community will pay an agreed upon commissions to both agents. You'll sign the buyer/tenant rep agreement allowing the agent to represent you, then you and your agent will work together to locate your new home. Since apartment renting is a bit different than leasing a home, your agent will be a wonderful resource in guiding you through the application and screening process. He or she will also help you avoid certain pitfalls and make clear what you should expect from the time you submit your application to the day you receive your keys!
