I\'m curious to know if a seller needs to provide any disclosures if they are selling land. Since we do not have zoning here, how does anyone know if a particular lot is designated for commercial or residential? What is the liability on the seller\'s end of the property is in an HOA?

Section 5.008, by its terms, applies to sales of “residential real property comprising not more than one dwelling unit” and does not apply to the transfer of real property on which the “value of any dwelling does not exceed five percent of the value of the property.” Tex. Prop. Code § 5.008(a). Thus, the statute plainly applies to sales of real property on which is located only one dwelling unit, the value of which represents more than five percent of the value of the property transferred.\n\nWhere a Property does not have any dwelling unit on it, the transfer of the Property does not fall within the scope of section 5.008, which applies only to a sale of “residential” real property.
