I do not practice law so I can not give legal advice on this issue, however, It seems like something worth seeking legal counsel on and seeing if it violates the DECEPTIVE TRADE PRACTICES ACT. For example, I would find out if the statements posted in MLS could fall under of a deceptive trade practice such as false or misleading advertising or exaggerating or misrepresenting the benefits...What also makes it interesting is the use of the word\"consideration\" which could be interpreted to mean a general term meaning: \"continuous and careful thought \" . Or it could mean \"a matter weighed or taken into account when formulating an opinion or plan\" which seems like it would be harder to dispute. Or maybe by \"consideration\" was meant mean from a real estate. I do as much research as possible for my (buyer) clients including (but not limited to) finding out the motivation for the sale of the property,look in HCAD to estimated what it owed, if anything on the property, etc. Also, I would encourage my client to move on and stay focused on the prize and pursue only deals that \"feel right\".
