After paying the deposit and first full month rent how many days the selling broker/agent need to wait for the commission check from the listing broker?

Hi George,Great question  and its one that comes up often when working lease transactions.In most cases, the listing broker is responsible for paying the cooperating (selling) broker once the lease has been executed and the tenants funds  including deposit and first months rent  have cleared. While there isnt a strict TREC rule stating the exact number of days, the standard practice in Texas is that the commission check should be issued within about 30 days after the transaction is fully executed and funded, unless your MLS or the listing agreement specifies otherwise.If more than 30 days have passed and you havent received payment, your next step should be to contact the listing broker directly  not just the agent  and request confirmation of when payment will be released. Under TRECs Broker Responsibility rules, its the broker, not the agent, who holds the duty to ensure commissions are paid to cooperating brokers in a timely manner.Also, make sure you are properly identified as the tenants agent on all relevant paperwork  especially the lease application and executed lease agreement. If your name and brokerage arent shown as the Procuring Broker, the listing side technically has no obligation to pay you, even if you introduced the tenant.So in summary: The listing broker generally has up to 30 days to issue payment after funding. If not received, reach out to the broker directly (not just the listing agent).
