Is there a form that should be used to change title companies, after a contract has been executed, or do you just use a standard contract amendment?

Amendment to Contract (Form ID: 39-8) and check Other Modifications and then simply write the title company has changed from Title company A (whatever company you are currently with) to title company B ( the name of the title company you are going to.\n\nAlso, make sure you have the yourself, the buyers, the sellers, and sellers agent sign the TAR-1904 Release of Earnest money, to release the earnest money from the undersigned (current title company) to the new title company. I\'m actually dealing with this right now with an investor that\'s giving us some issues. I hope this helps.

Do you execute contracts on Sunday or wait until the next business day?

You never wait. You always execute the day you receive it back signed. Sunday is just like any other day. Same for Christmas or Thanksgiving. There are no days off for realtors. Everyday counts. Option starts day after date executed.

Must the buyer submit the financing contingency by 5PM to get his EM returned or can it be submitted as late as 11:45PM on the final day?

Hi Denise!You have up to 11:59pm to submit a termination based on the third-party financing addendum, but just be careful cutting it that close. And be sure to count your days carefully! We've seen agents count the days wrong and miss the deadline. Once the termination has been received by the agent, it is assumed to have been received by the seller, as well.

When a person passes away and the house needs to be sold, how generally does a realtor get involved? Trust officer? Family friend?

We have been involved in several transactions like this when a son/daughter has to sell the home an elderly parent and one of the parents has passed away. If there is no will/probate, it can get complicated and heirship affidavits will be needed. The fact that a ownership is vested in a deceased party can also pop up in the title commitment - had this happen when adult children tried to sell the home of a divorced (elderly & with dementia) parent who, unbeknownst to his children, had gift deeded his home to his former wife several years ago, and was now deceased. No will, no probate and she had remarried prior to her death and had children with her new husband, who now claimed heirship to her interest in the home. Our take away from some of these transactions is to get as much information up front (pray that there is a will/probate), review the title commitment very carefully and be prepared to do some work! These cases are very interesting and a great learning experience!!

Can anyone advise me how I might be able to edit/change the sold price after I completed the status change to sold? I accidently input an incorrect sold price. The edit my listing won\'t allow me to make changes to the listing

Once a listing is changed to "Sold" status, you will need to contact HAR to make any corrections. They may also ask for documentation to support the change you want to make - in your case, the settlement statement showing the sold price may be requested. I learned this from experience.....

Can anyone comment on clients using the \"cash offer companies\" that charge a fee but will allow them to make a 100% cash offer?

I have been involved in several transactions using one of these companies. It has enabled buyers to make competitive offers in a very competitive market. Qualified buyers are able to use their own financing (which reduces the fee) while the company guarantees the purchase if the buyer is unable to complete the purchase (by using their funds, for a higher fee). In either case, the seller is paid cash at closing. Another advantage is the appraisal guarantee offered by this particular company - in one transaction was a $12K difference. Using one of these companies may not be appropriate for all clients, but in some situations can help buyers while also benefiting the sellers by guaranteeing that the sale will close. Best thing to do is do your research into ALL the conditions, fees and requirements to determine if this service will benefit your client and make sure your client is fully aware of all conditions, benefits and possible disadvantages.
