I remember when my neighbor put his trash can near my kitchen window and the smell was coming into my home. I confronted him and he moved it. A landfill, however, is not portable, nor are most homes. \n\nIs it viable to live there? “Is it advisable?”, is the real question. I think that this is one of those situations where you really have to dig and learn as much as you can about an area that your client is considering buying into. \n\nAs Realtor’s it’s our fiduciary duty to keep our clients in the know about anything and everything that will ensure informed decision making in their home purchase. Due diligence requires it. \n\nThere’s information on the internet about this specific community and their proximity to the landfill. I would read everything I could and do research on potential hazards and health issues associated with living near a landfill. The information is out there, access it, verify it, share it. Educate yourself and educate your client. It’s your ethical duty.

Need advice on how to handle the hydrostatic addendum? Finding it to be a deal killer. Since the test is no longer invasive, meaning leaks can be found at clean outs, there is no longer a need to pull toilets. Neither buyer nor seller want to be responsible for repairs caused by the test. What do you do?

This does seem challenging, but if the seller really is motivated to sell, I would think any possible repairs after the test should fall on them. \n\nCan any more details be given on the situation?
