Addendum for repairs

What form do I need

Thanks to all the experienced realtors who have managed to share the form. It is never a straighforward process when official documents are involved. A disagreement could ensue should the wrong procedures be put forward after all the works have been done.
This question has some great answers already! If you haven't written a repair amendment yet, I think it is necessary to talk to your broker to seek their input and ensure accuracy.
You have two forms to choose from, (the TREC or TAR Amendment to Contract form) they both contain basically the same information. Once you complete your Amendment to Contract form, however, please have your Broker or a supervising Realtor in your office proofread your form. It's a good practice to have an experienced Realtor or your Broker review your verbiage before sending to the client to sign.
Hello Phyllis,

Most use TREC 39-8, better known as the Amendment to Contract. This form can be used for many things. Reducing the agreed to sales price, changing the closing date, adding additional earnest money, etc AND discussing repairs. This is the form I would recommend using.

I would run this past your Broker but Tar 1903 paragraph 2 is what you would use.. Be sure, to run past your Broker for accuracy ????????
Yes, your broker / supervising agent should provide this kind of guidance but I can confirm that both Forms TAR-1903 and TREC 39-8 are the same and the correct form to use. TAR-1903 is the Texas Association of Realtors identifier while TREC 39-8 is the Texas Real Estate Commission identifier. You will find both numbers at the bottom of the Amendment Form.
Hello Phyllis: a question such as this should be directed to your personal broker. Your peers may or may not give you accurate information and ultimately your broker is liable for your misuse of the forms. With that said remember we are bound by the laws of TREC to use a a promugated TREC forms. The reason I mention this is because as you can read here you have two different answers. Also, there is a TAR Hotline to guide you
Phyllis,

TREC promulgated form 39-8.

Paragraph 2 reads:

“In addition to any repairs and treatments otherwise required by the contract, Seller, at Sellers expense shall complete the following repairs and treatments:”

See the attached link.

Hope this helps you.

Good luck!
Hi Phyllis,

You will use form TAR-1903 and fill out paragraph 2 with a list of repairs.
Just as any amendment to contract, it has to be signed by both parties (the Buyer and the Seller) and executed by the Agent.
