Being a former small business owner, BBB is a service to consumers but also a business in itself. Business owners have the ability to buy a membership and promote themselves through BBB. However, seeing a complaint history of almost 50 complaints is extremely concerning. Unfortunately, builders do not have a \"Board\" they have to answer to. They do not have the ability to become licensed by the State of Texas as most professionals do. I would be very weary of any business, much less a builder that has this reputation. Reputation is all that a builder has. The best judge of an unknown builder is to see how active they are in their industry- for example, if they are a member of a builder\'s association or promote and learn within their industry. We have a very active Greater Houston Builder\'s Association, which offers certifications and many resources for builders that want to better themselves. Many local or smaller banks will not be listed online, and you will need to contact each one for their current rates. If there are any surprises on your credit history, you will have time to resolve any issues. When you find the home you like, a letter of pre-qualification or pre-approval from the bank will strengthen your offer. Negotiations can take anywhere from a few hours to several weeks, but in my experience, the average is 2-4 days. In my experience, land that was not actively listed for sale- is still willing to be sold by the current owner. This lot has been cleared and the building plans are complete. Construction is ready to begin. No one involved in this transaction noticed the neighbors fence on the survey. The plans shows construction on top of the fence.

Assuming that your survey is correct, you can request the homeowner to relocate the fence. Many times, the neighbor will produce their survey showing their fence line to be correct. As technology becomes more advanced and the locators are more precise, this situation is popping up more frequently - most often in older neighborhoods. Problems arise when the fence has been there for many years. Depending on the length of time and how the land was used, the neighbor may be able to claim ''adverse possession'', entitling them to the land in dispute.

How do I find out who the builder is?

I am assuming this is not a newly constructed home being sold through a realtor who would have the information. If it is an older home, you can search the ownership history on the county website and hope that the builder had it registered under their company name at some point. If it is an individual''s name only in the history, you can search the deed records on the county website to view any previous lienholders (assuming the owner used financing). It is a time consuming process.
