if an agent is working with renters, can that agent pull the credit and background report to see if the renters qualify for the lease so that the agent doesn't waste his or her time if the renters don't qualify and charge the renter for the report?

I'd recommend having them pull their own credit check and background check. They need to confirm where they stand before making a bunch of applications to rent. Also, a lot of mom and pop landlords will take a copy from the renters. However, the more reputable management companies typically will insist on pulling the credit report themselves - because the only way they can be sure the credit report isn't forged is if they pull it straight from the credit bureaus themselves. Also, if you pull the credit report yourself, you would incur a bunch of privacy protection duties under the Fair Credit Reporting Act.
Have your clients pull a free credit report if they don't really know what their credit situation is. I believe creditkarma.com is a popular one, and free and they can do it themselves. As for background check, if your client isn't willing to be upfront with you, they will eventually have to submit to a check with the landlord. Best to inform them of it, and not take on unnecessary liabilities.
