You are house hunting and attend an open house, then consider using the agent holding it open, to represent you for your purchase! You do this, because you believe that they will have inside knowledge/influence, that you think is important( not an uncommon occurrence)!

When you are buying a property, in my humble opinion, you should use an agent that only represents you. Having the Seller's agent represent you, can mean, that the Sellers could find out your motivation, your financial situation and more, prior to your offer!

Dual agency (using the same agent to represent the seller and the buyer) certainly begs this question - How can the agent get the best price for you and also get the highest price for the sellers? It can be done, however, is it wise to let everyone know all of the cards, in your buying hand! Avoid a possible conflict of interest, if you can!

Finally, knowing as much as you can about the Sellers situation, such as the price they paid, when they bought and what liens encumber the property, can be so helpful when forming your offer!

Questions to ask.....

1. Are you only representing us, and if not, how will you make sure that we are getting the best possible deal?

2. Do you have any fiduciary responsibility to anyone other than us?

3. Can you let us know when the owners bought, what they paid and how much they owe (a good title company, like Chicago Title, can provide this information to your agent)?

4. Are you recommending any affiliated businesses (like title, escrow, lender, home warranty or disclosure report companies) and if so, how are you benefiting and why should we use them, instead of independent companies, to avoid a potential conflict of interest?
