The Roles MUDs and LIDs Play in Fort Bend County, TX

When you read the initials MUDs and LIDs and immediately think of wet dirt that children and pets like to jump in or think of hats sold at the shopping center, you may not be from Fort Bend County. Missouri City and Sugar Land city taxpayers pay taxes to their local MUD and/or LID.

What do these acronyms represent and what are their respective roles? Keep reading to learn what you need to know about MUDs and LIDs in Fort Bend County.

Municipal Utilities Districts (MUDs)are political subdivisions of the State of Texas responsible for providing utilities such as trash pick-up, drainage, and water/sewer services. A MUD is created by the legislature or by the Texas Commission on Environmental Quality (TCEQ).

Levee Improvement Districts (LIDs)are political subdivisions of the State of Texas responsible for keeping land dry. In Fort Bend County, this is done by providing flood protection and storm water management services across major portions of the area. You'll see LIDs in action with the numerous levees, drainage ditches, and pump stations.

How are these types of districts managed and who do they serve?

The districts are governed by publicly elected Board of Directors. The Board upholds policies created in the best interests of its residents and utility customers.

Both MUDs and LIDs serve master-planned communities varying in sizes from several hundreds to several thousands.

How are both MUDs and LIDs funded?

MUD funds are provided via municipal bonds which are purchased by the taxpayers. Homeowners then pay off these bonds through the MUD tax. As the debt decreases, MUD taxes may also decrease over time.

If you're living inside a MUD boundary that continues to grow and add homeowners, this action has the potential to lower your taxable portion as the total bond amount gets shared across more homeowners.

LIDs are not federally funded and rely solely on local ad valorem property taxes.

Those living inside both a MUD and LID will pay taxes to both districts.

Which MUD/LID am I located in?

During emergency events, such as an extreme rain event, LIDs activate their respective Emergency Action Plans which outline actions to be taken by the LID in response to such emergencies. It's good to know which district you live in or if your neighborhood is part of a LID.

As a Home Seller is there anything related to MUDs/LIDs I need to share with Buyers when I list my home?

This is a good question and the answer is yes. The Texas Water Code requires sellers to provide to a buyer, prior to the buyer's entering into a sales contract, a notice regarding the MUD in which the property is located. The seller will provide one of these three notices:

  • Notice 49.452(c) if the MUD is located within city limits.
  • Notice 49.452(b) if the MUD is not within city limits but within the extraterritorial jurisdiction of the city.
  • Notice 49.452(d) if the MUD is neither of the above.

Copies of the MUD Notice can be obtained from the county.

Each Fort Bend County Commissioner's Office maintains district information reports for the respective MUDs and LIDs in their precinct. You can reach out to a commissioner viahttps://www.fortbendcountytx.gov.
