Trying to sell a home that a former owner or someone passed away in? Do you disclose that to potential buyers, possibly giving them the creeps?

In the state of Texas, while aseller or agent has no duty to disclose death by natural causes, suicide, or accident unrelated to the condition of the property, perTexas Property Code 5.008, the answer is in fact more complex.

The danger for sellers and Realtors in not disclosing is having the buyer learn of them after move in - usually from the neighbors. To avert any spooky surprises, if you are a buyer, check the homes address on DiedinHouse.com. As for sellers just be upfront about it. If someone specifically asks, avoid being misleading because you and your Realtor are required by law to tell the truth to any potential buyer and failure to do so could cost you gravely, later.
