Are you a landlord in Texas and ever tried to evict someone? A lot harder than you expected, wasn't it? Well starting in January of 2026, a significant law goes into effect that will overhaul and streamline the eviction process. This is the biggest change to Texas eviction law in DECADES!
KEY CHANGES:
1) COURT TIMELINES - MUCH quicker thus reducing delays (generally 10-21 days). Get faster writs of possession(getting the sheriff/constable to remove occupants) once a judgement is entered & enforcement is expedited to around 5 days, and quicker summary disposition in clear squatter cases( if someone is clearly on the property without any legal right, a court can decide quickly without a full traditional trial)!
2)SO MANY MORE WAYS TO SERVE - Landlords now have more ways to deliver notices ( including mail, in person, and if agreed to, electronic service ) which helps avoid procedural delays!
3)POTENTIALLY HARDER TO APPEAL - Tenants who appeal MUST pay rent into the court registry during appeal period!(prior this was ambiguous with less direct language and handling varied by court)
4) CONSISTENCY FINALLY - This law standardizes eviction procedures across Texas so local courts or municipalities cannot impose their own additional steps unless legislature authorizes them. No more rebels!
5) COURT RULES - UPDATED - The Supreme Court has rewrote Rule 510 of the Rules of Civil Procedure SPECIFICALLY for eviction cases to align with this new law!
THE REAL FOCUS? Unauthorized Occupants, or Squatters! - Although a separate squatter-removal law took effect September 1, 2025, this change is supposed to streamline evictions of unauthorized occupants making it WAY more efficient when someone has no legitimate right to be there!
What is NOT Changing? Traditional tenant protections and notice periods ( such as the basic 3 day notice to vacate, etc. ) remain part of Texas law, however the procedure around them is now clearer and faster!
