To start off, I cannot tell you how many renters I talk to whodo nothave a copy of their lease, weird huh? Why, why, why didn't they ask for one? I suggest if you are in that number, to contact your landlord and ask he/she to provide a copy to you. If you are on a verbal contract suggest a lease in writing, right away. Under the Texas Propery Code Title 8, Residential Tenancies, Sec 92.0561 The tenant is allowed to pay for repairs affecting the health, welfare, and safety and offset them (basically, pay for repairs and withhold the same amount from your rent) as long as it does not exceed your monthly rental amount. Normal wear and tear doesn't count. Make sure you have copies of repair invoices to provide to the landlord and keep a copy in your records if you plan to take legal action. P.S.Always keep copies of your rent payments just incase a problem arises concerning the timeliness of your rent or rent payments. Looking to move into a rental in 30days or less, give me a call.
