Terms of Use
Houston Realtors Information Service, Inc. ("HRIS"), a wholly-owned subsidiary of Houston Association of Realtors, Inc., with the cooperation of its REALTOR® and non-REALTOR® brokers and agents who are MLS Participants and Subscribers, owns a multiple listing service for residential properties (the "MLS") and operates HAR.com. By accessing MarketInsight and HAR.com, you agree to be bound by the below Terms of Use.

MarketInsight
You previously provided your name and email address to the broker or agent that invited you to access MarketInsight so that you can obtain critical information about your property - listing traffic, appointments, nearby comparable properties, subdivision price trends, zip code analysis and more (the "data"). By creating your password and registering to access MarketInsight, you acknowledge:

• Receiving and reviewing the Information About Brokerage Services document from the broker or agent that invited you to access MarketInsight, however you are not required to work with that broker or agent, nor does it impose a financial obligation on you.
• That HRIS, which supplies the data, owns or has certain rights in and to the data and you acknowledge as having no rights, and will assert no rights, in or to the data.
• That all data obtained from MarketInsight is intended only for your personal, non-commercial use; that you have a good faith interest in the sale, purchase or lease of the property being profiled through MarketInsight; and that you will not copy, redistribute or retransmit any of the data provided except in connection with your sale, purchase or lease of an individual property.
• That HRIS or you may terminate your registration and access to MarketInsight at any time.

General Disclaimer and Limitation of Liability
MarketInsight and the data and services associated with it is provided "as is." HRIS disclaims any and all warranties, express or implied, including without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement. HRIS disclaims any warranties concerning the availability, accuracy or usefulness of the data and services provided through MarketInsight.

Use of MarketInsight is at your own risk. Neither HRIS nor any of its directors, officers, employees, contractors, agents, successors, assigns, affiliates or MLS Participants and Subscribers shall be liable for any direct, indirect, punitive, incidental, special or consequential damages or any other injury arising out of or in any way connected to the use of MarketInsight, including any damages arising out of the inability to access MarketInsight.

Indemnity
You agree to defend and indemnify HRIS, its directors, officers, employees, agents, successors, assigns, affiliates, MLS Participants and Subscribers of and from any and all claims, attorneys’ fees and damages incurred and arising out of your use of MarketInsight or the data.

In addition to the above Terms of Use, you also agree to be bound by HAR.com Terms of Use and Privacy Policy. If a provision in these Terms of Use conflict with a provision in HAR.com Terms of Use, then the provision herein shall apply, though additional language itself shall not be considered a conflict.
