Adding a spouse if your getting a divorce

If I am going through a divorce and my husband is in Korea. I am moving to Texas. Do I have to add him to my new purchase for my home loan. Do I have to add him to title?

But- if I was in a similar situation, I would have waited till my divorce is final before purchasing a property. Hope this helps.

Consult with the attorney that is handling your divorce for specifics related to your particular situation. Texas is a community property state with laws that apply strongly to the homestead a couple lives in together, and also to any separate property purchased or sold during the marriage.Married people are able to purchase property without the spouse (separate property) but when doing so while still married may trigger that the ex-spouse receive a portion of the proceeds years later when the property purchased during marriage is sold. Ask your attorney to show you where within your divorce decree is the language about your being able to buy/sell real estate without owing your ex-spouse any of the proceeds or title to the real estate.
