3 questions about Bonus to Seller Agent- BTSA

We are working with a developer and would like to know the rules and regulations around BTSA to help them sell their properties:

1. Does a BTSA have to be listed on the MLS listing?
2. Can it be offered at a real estate event as a certificate for attendees?
3. If so, can the BTSA be offered at different levels (i.e.: 3K for attending without a client, 5K for attending with a client)?

MLS provides a space for BTSA to be added to any listing. It asks you the start and end dates of its offering as well. That will help agents learn you are offering If they miss other marketing promotions you do to advertise it. I’d personally add to the MLS. You can put in agents notes to speak to an agent at your office about further details or something to the effect if you have progressive terms.

Commission is negotiable in Texas. What a seller is willing to pay a buyers agent is totally up to them. They can pay more than the “standard” 3%, offer a bonus, or even give bonuses in the form of vacations, gift cards, etc.
It does not have to be listed in the MLS.

The BTSA help promote sales and it moves inventory no seller wants their products to sit unsold. Some agents that have brokers to pay will go after a property that offer a BTSA first.. A broker like myself I earn my clients by trust not by getting a BTSA bonus.

A Bonus added to a transaction can be a great incentive to an agent selling homes in a particular area and with the criteria that their client is looking for. The place to list such a bonus could very well be in the MLS system. This added bonus may very well help a seller to sell their home faster. This type of bonus can definitely set a home apart and even a new construction home by a builder apart from the other homes for sell and from the other builders. For this reason, a seller or builder may certainly want to post this amount for an agent to see.

Question 1. Yes BTSA can be listed in the MLS. I think it is a great incentive to the agent as well as the client. This can definitely set the builder apart from the other builders.
2. I am not sure.
3. I have seen builders Tier their BTSA. Depending on how many homes you sell with that particular. Of course, there is a max, mostly at 3 sales being the highest.

BTSA is a compensation offered by a seller in order to encourage buyers agents to bring in buyers. There are no restrictions regarding what a seller can offer as an incentive. It is very common with new home builders and can be found on some resale homes. It can be listed on the MLS but is not required either. Again, sellers can offer you whatever they would like as incentive for you to bring in buyers. I have not run across your specific example, but I have seen quite a few builders offers increasing amounts for multiple closings withhin a certain time frame.

If it's listed in MLS, I don't believe there can be conditions that change the compensation. We are not allowed to do that with agent compensation. However, with such a specific question, you might consider reaching out to the MLS department within HAR.

BTSA can be listed in MLS if you want to attract more agents to promote your listing.
