3 questions about Bonus to Seller Agent- BTSA

We are working with a developer and would like to know the rules and regulations around BTSA to help them sell their properties:

1. Does a BTSA have to be listed on the MLS listing?
2. Can it be offered at a real estate event as a certificate for attendees?
3. If so, can the BTSA be offered at different levels (i.e.: 3K for attending without a client, 5K for attending with a client)?

BTSA can be listed in MLS if you want to attract more agents to promote your listing.

If it's listed in MLS, I don't believe there can be conditions that change the compensation. We are not allowed to do that with agent compensation. However, with such a specific question, you might consider reaching out to the MLS department within HAR.

BTSA is a compensation offered by a seller in order to encourage buyers agents to bring in buyers. There are no restrictions regarding what a seller can offer as an incentive. It is very common with new home builders and can be found on some resale homes. It can be listed on the MLS but is not required either. Again, sellers can offer you whatever they would like as incentive for you to bring in buyers. I have not run across your specific example, but I have seen quite a few builders offers increasing amounts for multiple closings withhin a certain time frame.
