Disclosures about Flooding

We are thinking about selling our elderly parents home which flooded several times prior to the Corp of Engineers fix in 2000, and then did not flood for 17 years until Harvey. The house has been completely remediated and repaired, but what would be our responsibility to disclose should we decide to sell? I live out of state and have for many years so truthfully I do know the full property history.

Hi Kathy,

I am sorry to hear that your parent's home flooded during Harvey. It was such a bad event and so many homeowners are still trying to put their lives back together.

It is the seller's responsibility to disclosure all known material defects about the property.
When listing the house for sale, your agent will ask you to fill out the Seller's Disclosure Notice- it has areas to disclose whether or not seller is occupying the property, whether or not there was any previous flooding into the property or the structures and whether or not the property is located in 100-year floodplain, and whether or not the owners have ever filed a claim for damage to the property with any insurance company.

Since you haven't lived in the house, you may not know all the details about the property, but if you are aware of the flooding, you should disclose that.
