I am being asked to not park my private vehicle in my driveway. They are calling it a commercial vehicle. She calls them all the time, and is friends with the Pres.

I am with Francois. Work with your HOA and handle it right away. Ask for extra time if needed.. Fighting against them only aggravates them more and they find more faults nonstop.

HOA have quite strong powers, the best is to mediate with them and try to solve it in a civilized manner. They can make life difficult for you, so try to mediate it.

Hi Stacey, have you looked into the HOA bylaws? It should state what HOA can do it. Also check under deed restrictions. Hope this helps.

Whenever I have an unusual request from the local HOA, I drive around and take pictures of all of the other offending properties and send those pictures with the addresses and tell the HOA that they are discriminating against me and I will file a suit if it does not stop. Then if I have a particular neighbor that is way too picky, I take several pictures of their house and send them to the HOA with every little thing I find wrong...old paint, weeds, door needs refinishing, bushes need trimming etc...my nosey neighbor stopped bothering me after that.

Since there is no way to keep someone from making phone calls or complaining, I would first check the deed restrictions for their definition of a commercial vehicle. If your vehicle does not fit the description, then the HOA should not be able to do anything. Has the HOA sent you letters or is it just gossip? If the HOA has sent letters or threatened action, you should consult an attorney.

Good Afternoon Stacey,

The direct answer to your specific question is that no one can "stop a neighbor" from making any phone calls.

Your dilemma, however, seems to be with the legal classification of your "car/vehicle," as you've called it. If it is legally classified as a commercial vehicle and the HOA governing the neighborhood in which you reside forbids parking such "cars/vehicles" in personal driveways, then it is likely you will need to find another place to park that "car/vehicle."
