City of Bellaire - question regarding Certificate of Occupancy

Good morning - I am new to the community and have a question regarding Certificate of Occupancy from a Tenants perspective.
The question is this: Is a Tennancy Agreement void or voidable if it is discovered that the Landlord failed to obtain a Certificate of Occupancy for the leased property within the City of Bellaire?

I have heard that this is a mandatory Certificate which must be in place.

Thank you

Ali, great question! The link below will take you to information about the City of Houston's "Certificate of Occupancy." Keep in mind that Certificate of Occupancy is not required for residential properties. Best of luck!

You should consult with a real estate attorney on whether or not you can void a lease based on the lack of a Certificate of Occupancy. The failure to obtain a Certificate of Occupancy maybe a violation of the municipal code, but may not be the sole reason you could justify voiding a lease.
