I have a few days left of my option pending period, I ask for another inspector who is a plumber specialist in bring camera for unseen pipes but owner refuse --is it a breach of contract. we give him $300 check. is it right for him to return it?

The seller is obligated to allow any inspections a buyer wants to do during the option period, so if they are refusing, they are in default in the contract. I would suggest calling a TREC attorney to see how to proceed immediately before the OP period is over.

No! If you are still in your option period he is bound by the contract to allow multiple inspections if that is what your asking. If you have a realtor representing you in the transaction then let them deal with it. You have the option to cancel the contract and lose your options money.

Contractually the Seller is obligated to allow showings, unless that portion of the contract has been struck by the clients; which is highly unlikely.

The seller must allow you to do inspections by licensed professionals as long as the property is not harmed. You as the buyer can terminate the contract during the option period and only lose your option fee. The seller can't terminate the contract and he must allow you to do inspections.

There seems to be 2 parts to your question. The last part is saying that he returned the option fee to you, is that correct? Very odd.

Regarding your option period. You should be allowed to do multiple inspections. If you need more time because they aren't allowing the inspections, you can extend the option period with an amendment. If they flat out don't want any more inspections, I would cancel the contract and move on. The seller is likely hiding something.

You do have the right to multiple inspections. You should insist on going back for the next inspection.

During the option period you have the right to multiple inspections. Something seems odd if the seller is refusing access. You have the right to cancel the transaction and a right for a refund of the option money due to the seller refusing to work with the seller.
